The Agreement supersedes all previous oral and written terms and conditions (if any) communicated to You.

THE WEBSITE

Users: This website is available to registered users, non-registered users and healthcare professionals. Registered Users are those who have created an account by providing certain information to DRS Booking. They can then log in to the Website using their username and password. Non-Registered users are those who have not registered on the Website, but can still access the information. Only Registered Users have access to certain features on the Website.
Features of the Website: The Website offers the following features:

For Registered Users:

Platform to request generic and preliminary information from HCPs. At this stage, your identity is not revealed to HCPs or other Registered User.
Access the information of an HCP regarding questions submitted by Registered Users on this Website.
To schedule an appointment in person with HCP, you can use the Website.
After paying a consultation fee to HCP, DRS Booking will charge an internet handling fee and a consultation fee. However, this fee is not more than that of HCP consultation fees.

For Non-Registered Users:

Access to HCP Profiles. The HCP profile includes their name, qualifications, experience, specialization and personal statement. It also contains information about professional affiliations. The User can access HCP profiles from the Website.

Access to HCP Availability for in-person appointment: In-person appointments are available. Based on information provided by HCP, this website shows you an indication of the availability for appointment at HCP's premises.

For HCPs:

Platform to publish profile: Upload your profile with your name, qualification and experience, specialization fees, personal statement, education and professional memberships, etc. All Registered and Non-Registered Users can access your profile..
Platform for private interaction: Registered users can use DRS Booking to have private interactions. Private interaction allows you to exchange text, images, and videos via the chat function of the website. You also have the option of communicating through the DRS Booking, such as calls.
Platform to receive consultation fees for non-Website interaction: You can use the Website for fees to be collected for your interactions with registered users outside of the Website/offline.
Platform to provide information to questions to health related questions submitted by Registered Users: You can provide your preliminary and general information to help answer health-related questions submitted to Registered User.
Platform to publish HCP-contributed health related information and education material: You may contribute health related information and education material which DRS Booking may, with or without modification, in its sole discretion, publish on the Website.

Types of content on the Website:

The various types of content available on the Website are as follows:
Content provided by Registered Users in the course of private interactions with HCPs
Content provided by HCP including health related information and educational material
Content provided by Labs including instructions
Content which DRS Booking has generated or procured for the Website

USE OF THE SITE

All Users (Registered, HCP and Non-Registered) can use the Website. The Website and its features will only be used in accordance with applicable laws. This Website and any feature offered by it will not be used for any purpose not permitted under the Agreement.

You won't use the Website in a way that is illegal or harmful to DRS Booking, its employees, affiliates distributors partners service providers, and/or any User or data or content.
DRS Booking may send messages to your mobile number as part of Your registration and during your use of the website. These messages will be about your registration, the transactions you make through the Website, and any other information that DRS Booking considers appropriate.
By using the website and/or registering yourself at DRS Booking you authorize us to contact you via email or phone call or sms and offer you services for the product you have opted for, imparting product knowledge, offer promotional offers running on website, for which reasons, personally identifiable information may be collected as detailed below.
We encourage You to independently verify any information You see on the Website including information provided by a HCP. You will use the Website and the features provided by the Website only in relation to and in compliance with all applicable USA laws. You will not use this Website or any feature provided by the Website for any purposes not intended under this Agreement.
The Website lets you schedule and select appointments with HCPs as a registered user. DRS Booking will help you to find the right HCPs to provide the care you need based on the information that you give.
DRS Booking (i) does not endorse or recommend any HCPs listed on the Website. (iii), does not make any representations and warranties with regard to HCPs and the quality of any healthcare services they may offer. (iii). Does not grade doctors.
The Website allows you to schedule appointments for your family members or friends. Please note that this You will be responsible for all activity performed through the account for his/her family members or friends.
The Website allows you to upload your identifiable health information, including your physical, physiological, and mental health conditions, as well as medical records and histories. This information may be accessible by the HCP during private interactions via the Website.
DRS Booking will levy an advance internet handling fee for each private interaction that You have with an HCP through the Website. DRS Booking will also collect the consultation fee payable to the HCP in advance on behalf of HCP and pay to HCP without retaining any share from fees.
DRS Booking will provide profiles and/or lists of HCPs to you as a non-registered user. These lists are based on the information you have provided to the website's search tools (such as your area of specialization and geographic location). DRS Booking (i) does not endorse or recommend any HCPs listed on the Website and (ii) does not make any representations regarding these HCPs, or the quality of any healthcare services they might provide.
If a Healthcare Practitioner (HCP) is unable to provide a paid consultation, you can notify DRS Booking. It will then process a refund equal to the amount actually paid by you. This includes any internet handling fees. The discount value offered by DRS Booking will not be refunded.
You have seven days to notify us if you are unhappy with any consultation and request a refund. After that, no refund requests will be accepted.

ROLE OF DRS Booking

DRS Booking's role is to: a) provide a platform that hosts and publishes User Content, Lab Content, and HCP Content; b) provide a platform where Registered Users can raise health-related questions and HCPs to provide generic and preliminary information to those questions; c) provide a platform to interact privately between Registered Users and HCPs; d) provide a platform to locate HCPs using Registered User's inputs as well as HCP profiles created directly by HCPs. f) allow Registered Users to place Lab Tests.
DRS Booking is not required to monitor or pre-screen any User Content, Lab Content, or HCP Content. DRS Booking can, however, choose to monitor User Content or HCP content and remove User Content and/or HPC Content from the website if DRS Booking deems that such User Content or HCP is in violation this Agreement or any applicable laws and best practices. DRS Booking will attempt to notify the User or HCP that posted the User Content or HCP content. These actions don't in any way negate or diminish DRS Booking’s role as intermediary nor impose any liability to DRS Booking regarding User Content and/or HPC Content.
DRS Booking has the right to notify the relevant authorities and government if it suspects that any registered user, lab or HCP is engaging in illegal, wrongful, or fraudulent activity via the Website. DRS Booking will assist in any investigation or request for access/information made by any government or law enforcement authority.
DRS Booking does not endorse or influence control over any particular branch of medicine, theory, opinion, viewpoint or position on any topic.

The Website may contain links that will direct you to third-party websites / applications/ content providers or advertisers (collectively, "Third Party Websites").
DRS Booking is not responsible for any third-party websites that you may be directed from this website.

DRS Booking and/or its licensed licensors claim all rights to the names and trademarks on this Website. The name "DRS Booking" is the trademark, copyright, or any other intellectual property rights of DRS Booking, and/or its licensors. Without a written agreement, any use of DRS Booking's trademarks and copyright will be considered an infringement of DRS Booking's trademarks and copyright. DRS Booking grants you a limited, royalty-free license to use the Content in USA when You use the Website in accordance to this Agreement. This applies to the time you are either a Registered user or an HCP, or the time you use the Website.
This Agreement is not intended to confer any license to intellectual property rights on you, except as explicitly stated.
DRS Booking has not authorized you to modify, copy, sell, distribute or mirror the DRS Booking Content in any way. Copyright notices, trademark notices, and other notices of ownership must not be removed or modified.
DRS Booking is granted a perpetual, non-revocable and worldwide royalty-free license to use such User Content (in the case of a Registered User), or HCP content (in the case of a HCP). This includes the right to reproduce, display, copy, modify, adapt, alter, or adapt the User Content or the HCP Content as well as create derivative works from the User Content/HCP Content.

Any search results You make on this Website for HCPs or the provision of access to HCPs based on Your request should not be taken as an endorsement of such HCPs by this Website. There are no representations, warranties or guarantees made by this Website regarding professional qualifications, work quality, or expertise of any HCP. Search results are based upon an object computer algorithm.
DRS Booking is not responsible for any HCP's breach of service or service defect.
We cannot guarantee that transactions will be completed on the Website. We also can't guarantee that HCP will fulfill any obligations. Before you choose a HCP, we recommend that You conduct your own research.
You agree and understand that all interactions with Lab(s), as well as associated issues, on the Website are between you and the Lab(s). DRS Booking is not responsible for any interactions or associated issues. DRS Booking does not provide any medical advice, diagnosis or healthcare services and is therefore not responsible for any outcome between you and the Labs that you interact with. It is at your own risk to engage a Lab to perform diagnostic or lab services for You. No representations, warranties or guarantees are made by DRS Booking regarding professional qualifications, work quality, or expertise. DRS Booking is not responsible for any Lab's breach of service.

The HCPs, Labs and DRS Booking are not responsible for data breaches or losses including Personal Information due to events outside their control or technical reasons or actions of third parties.

DRS Booking and its affiliates will not be held liable to any indirect, special, incidental or punitive damages. This applies regardless of whether DRS Booking was advised of the possibility or could reasonably have foreseen such damages.

REPRESENTATION AND WARRANTIES

TERMINATION

DRS Booking reserves all rights to suspend and/or terminate Your user account and/or your access to the website if it determines that You have violated the Agreement. This may include blocking Your IP address and email id without prior notice to you. Suspected illegal, fraudulent, or abusive activity could be grounds for suspension and/or termination of your user account and/or access to the website. The suspension or termination of your access to the Website will immediately end. The Company also reserves the right to delete or remove any information about you that it has, including login and account information.
